There is something I have been thinking about.

A lot of people do not like the Roe decision becuase it ultimately rested on the right to privacy, which was also found in the Griswold case. (a little background: Griswold v connecticutt preceded Roe, and it was about the right to contraception. The court ruled that there is a right to privacy that allows a woman to have contraception and that the states could not make laws saying she could not get contraception).

So, what I don't get is how people who are against the finding in Roe are not also against the findings in Griswold, as they rest on the same idea.

And, if you are against the privacy finding in Griswold, what would you have wanted to them to rule? Where/how would you see the right to contraception protected by the constitution? or do you feel it is not protected and laws could be made against the use of birth control?

In the USA, roe v wade was the supreme court decision that made abortion legal. Griswold was a case before the roe case that made contraception legal and laws against contraception unconstitutional. Both of these cases rested on the idea that the Constitution allows for a right to privacy.

Some people argue that they do not like this idea of right to privacy. Many of these people say they do not like the roe case because it rested on right to privacy.

So I am asking, if you are one of these people, where would you rather the court have "found" the right to contraception. or are you not in favor of protecting people against laws that prohibit contraception.

I can't fathom that anyone would be against the right to privacy and contraceptives...

Just yesterday John McCain came out saying he opposes R v W and will not appoint judges that legislate from the bench. So right there we see that our politicians want Roe gone and do not agree with the right to privacy (which they see as being a loose interpretation of the constitution and "legislating from the bench.")

Yet we rarely hear them talking out against Griswold, which gave us the right to contraception (well, the right not to have legislation barring us from getting it) but was also based on the right to privacy.
