and keep the kids out of it as for right now there are 3 kids playing with any plant as in digging out of the pots and throwing soil on to the ground.

You garden with containers, right?

You could put tomato cages in the containers to deter the kids from touching them. Have you tried a sign? Don't touch!

How old are the kids? Can you get plant holders and hang them up out of reach.

If you have rows, use spun row cover.
