Well we went up to city hall yesturday to talk to them about the fence. They werent much help. They just told us to get another survey done on our lot and if it showed the fence to be on our side that we have a right to take it down. So when we got home I started calling around to places that can come out this week and do a survey and they wanted $230 bucks to do it. We think thats to much. Mike is going to call the city again today and talk to someone in code enforment because what we dont get is our lot had a survey done on it last April before we moved in and it shows the fence in our lot. And we dont understand why we have to pay to have another one done but I guess they moved the proporty stacks so it looks like the fence is in their yard. Mike went and measured it for his own benefit and they are both inches from where they should be. Well my uncle is the contractor that built our house and so they use one guy to do all their land surveys so he is going up there thursday to see if they guy will give us a deal and do it friday because we have someone coming this weekend to dig the post holes. Well when Mike was out there measuring sure enough the old lady came out trying to tell us that they didnt move the stacks and that the fence was put up before they moved in. I told her it doesnt matter if the fence was up before they moved in that if its proven to be in our yard that we have every right to take down whats in our yard. She tryed telling me that we cant take down half the fence (the rest of it is in our new neighbors yard) and I told her that they can take down the rest when they put up their fence. She never stops talking long enough to let anyone else talk. I think they think because we are a young couple that we dont know what we're doing but it helps having my uncle involved because he knows a lot about it. When Mike measured even the posts for the fence were in our yard not just the meshing. Well thats the update for now. I hope once the survey is done and its proven yet again that the fence is in our yard that we can take it down and put up our privacy fence and be done with them. We dont plan to ever move so its going to be a long time before we dont have to deal with them anymore.

oh I hope you can get things settled soon and get that fence up!!

When we did ours, the survey cost over $400!

One thing after another. sheesh.

I hope they can pull the old (not that it is that old) survey and use it. If in the end you have to pay I totally would pay because it sounds like you really need that fence up. Good luck. Please KUP

Sorry that you have to deal with bad neighbors...I hope everything resolves quit and painless. We are one of those that have nice neighbors, when we did out fence we did not have to do any surveys or anything, we just removed the old one and put a new in-it did not matter if it was in the same place as the old one or not. So good luck with it.

if your neighbors want the fence so bad, cant they take it down and put it up on there property? that way you guys dont have to deal with it and the cost of it?

Your neighbour sounds like a real *B*!

Good for you and Mike looking into every possible angle on how large your lot is. At least the police are involved and KNOW about what is going on. Incase you have to get them involved again, they have a report from you guys.

If I lived closer, and my cousin lived down there too, I'd ask her husband to come survey your land. He does that for a living. It wouldn't cost you over $200 either!

I hope you guys get this settled soon, you don't need the old hag bothering you guys, especially with all this nice weather!!!

That sucks that you have to pay for another survey I hope you can get a good deal at least and get that fence up quickly.
