My daughter was in 2 daycares last year. the first one we still owe $100 but cannot pay it at this time we just don't have the extra money. They are trying to hold our receipt for all other payments last year until that is paid. Are they allowed to do this?

I would call a tax lawyer and ask them. I would say yes they can hold it for the outstanding monies due to them but ask a professional.

You don't have to file the receipt with your taxes if you file electronically, so if you know the amount you can put it in your return and pay them with your refund if you're getting one.

I don't think they can withhold the form because they have to report what you paid last year. You can call the IRS hotline directly and skip the lawyer. It will be free and they know all of the tax laws.

i doubt that they can hold it. All tax forms are supposed to be mailed by jan 31 or they can get in trouble. I'd report them to the IRS. Also, if you send them even $10 a month, they can't do anything to you in your credit report. I'm sure if you showed them good faith that you intend on paying the will be happy to work something out. If they don't, i'd report them.

The daycare provided a service and was not paid in full for that service. What they can do is send the outstanding bill to a collection agency who will put it on their credit report for 7 years. Even if it is paid off it will show up as a paid collection.

Well, they do answer tax questions, it's free and it's an 800 number, so it's hotline-esque. Definitely not a secret though.

My first child care provider I never even got a receipt, but you'll need their tax id # or SSN to report it, so you'll have to get something from them. My current child care is awesome at giving me this stuff and will even hold on to the receipt until I'm ready to do my taxes. Good luck with everything!

I talked to the irs today (thanks courtney i knew they had a line but never thought to call it being in testing frenzy and super mad at them lol) they have to give me a tax id (whichi have) and in the state they are in they are required to give me any info in Sara's file that I reuest including billing info (aka receipts). I have a call into the daycare and the corporate office of the daycare (it is a chain) If i haven't a call before 11 eastern time tomorrow they are going to see crazy lady bust out of the shell. I have been nice long enough. If i had any income i would pay them but I don't so they can send it to the collection agency
