I have no problems with this, but have to wonder how his marriage is considered legal if he can still have children. I guess I don't understand laws well enough.

Linds, I think you and I are confused about the same thing.
I find it interesting that he's legally a man if he still has female organs and hasn't been taking testosterone for 2 years. I don't know how the law defines a male or a female. Same sex marriage is not legal in most states in the US. I can see why their marriage is legal since he's considered a male, but I'm confused how he's considered a male based on his female organs and not taking testosterone. Is he a male because he has removed his breasts and considers himself male? I'm not sure how to put this elegantly. If a female has breast cancer, has a double mastectomy and chooses not to have re-constructive surgery, she is still female. Physically he is not different from this scenario. So does the law consider him male because that's how he defines himself?

I actually watched this on Oprah with my Mom today. I was in and out of the room though so I didn't catch everything. He had to live the life of a man for at least a year before the doctor would continue on with anything hormonal or surgical. I believe this is the norm for gender switiching (I could be very wrong though). I know that he took his testosterone and that helped form a very small penis from his clitoris. He said he can even have intercourse.
As far as the legalities, I can't remember exactly what they said, but I think the fact that he went through certain surgical and hormonal measures to become a man with the intent of becoming a man allows him to legally be considered a male thus making the marriage valid. I am very sure I'm forgetting something here though.
I guess he suffered from an etopic pregnancy before this one and they took a fallopian tube. The thing that gets me is that they used a syringe (that they got from a vet's office) and the wife injected the donor sperm into the husband at home.
That was just the strangest thing I've ever typed I think.
