I was just wondering.. this is our 3rd lease term in this apartment complex (starting the 3rd year) IF James finds a job.. and we have to relocate.. our next lease is not up til august I mean we could be probably be ok moving out as early as june.. but if we have to move before then.. i dont want things keeping us.. does ne one know what we would have to do?

You can sublet your apartment....basically you would have another person take over your lease. They would sign the same contract as you did except it would end when your lease ends. I have actually done this when I moved and didn't have a problem.

Or you can talk to your management and see if they would let you out early....under the circumstances.

Since you've been there for so long, why not ask to go month to month or for a shorter lease term?

I agree with Kim... I would ask to be placed on a month to month lease. That way the most amount of notice you'd probably be required to give them would be 30 days.

If you sign a full year's lease and then break it, if they let you out of it... technically you could still be on the hook for the rent for the remainder of that lease. If it takes them 3 months to find a new tenant, you can be held responsible for the rent for those months.

That's why a month to month would be the best way to go. I would be surprised if they refused given the amount of time you have been with them.

i'm not sure i'm understanding you, are you currently in a NEW lease till Aug? We have rental properties so i'm pretty well versed on this stuff. IF the landlord allows you to sublet, you can, but that's IF, not all do. We don't let our tenants sublet cause it's very important to us the quality of people we rent to. In a sublet, the renter is desperate to get out of the lease so they will sublet to anyone, which could be a nightmare for the landlord. Some. like us, will simply be nice and let you go early, but you have to get a signed release from the lease cause you are legally financially liable for the months the apt is vacant under your lease. I didn't think month-to-month was an option since you already signed the lease???????? if you have any other questions, like I said, i'm pretty well versed in leases.

When I read it, I was thinking what Lynda was and thought you already signed the lease til 8/2010. From my experience (in Texas), apartment complexes will charge a higher rate for a lease that is shorter than 1 year. And some places don't allow month to month. Where I live, we are a HUGE college town, and the only places you will find a month to month lease is the old, ratty apartments with high crime rates OR during the summer when alot of the students go home. But since you've been there for so long and if you haven't signed a new lease, it is certainly an option to ask about.

But if you have signed a lease, I stick with my suggestions above. I live in a huge college town (student population of 48,000) and subletting is done often because of the students - some people aren't meant for college life or change plans. Alot of the complexes here are corporately owned rather than individual, so that may be the difference with subletting. They care more about the $$$$ than the quality of tenants.

I would talk to the apartment manager and see what your options are. Since you have lived there so long they may be willing to work with you. Just tell them that your hubby is job hunting for something better and you aren't sure where it will take you (they don't need all the specifics). They do usually charge more rent for shorter leases.
