NY's Day: Holy Day of Obligation? Or not?

I'm getting mixed answers on this...my BIL, who works for the church says it is not. My calendar from last year and this year both say it is for USA and Canada. My MIL called her parish to get a mass time and the recording said, "New Year's Day is NOT a Holy Day of Obligation" We're thinking it may be decided by local Bishops, which is odd, IMO.

So, is it where you live?

The Solemnity of Mary, Mother of God is celebrated Jan. 1, and yes.. normally it is a Holy Day of Obligation. However, the obligation can be abrogated in the United States when it falls on either Saturday or Monday. So this year, falling on a Tuesday, it should have been a Holy Day of Obligation throughout the United States.

I think it is so silly for the US Bishops to allow this kind of confusion.

This is exactly what dh and I believe to be true too. And that it is silly to have so much confusion on the issue.

I was at Mass, it was a Holy Day of Obligation in my diocese at least.
