I was in a car accident on Friday afternoon. My car is totaled. I was at a stop light and from what witnesses said the lady that ran into the back of me was doing about 50 and didnt even break. My car then smashed into the car in front of me. I dont remember much.
Good news for me is that my jelly bean is a fighter and is doing ok. Placenta is also still attatched. Doctor said that if I had been further along the baby probably would not have made it but almost 15 weeks pregnant baby had lots of room and fluid protection.
I am in a lot of pain. My back and neck are messed up and naturally they didnt want to do an xray because of me being pregnant.
Bad news for me is that Michigan has a no fault law.... which means nobody is at fault and that my insurance will only pay blue book value for my car and I am stuck paying the remainding balance ($3,000). The lady's insurance company pays me nothing and I cant sue her =NO FAULT. SMH! Now, I will have to come up with money for a down payment on another car. Just doesnt seem fair when it wasnt my fault at all
I am thankful but stressed out. Thats a lot of money to come up with!
Still worried about the baby.

Oh I am so sorry! Car accidents are so terrible. I hope you feel better soon. I dont understand the no fault thing. I live in california and people are held responsible for causing accidents. I got in an accident in feb and my car was also totaled, however my insurance had been canceled (long story) and the other guys insurance did not find him responsible for causing the accident. I was also hit by the guy doing 50mph and I was doing 10, except he ran a stopsign and I t-boned him. Im so happy your bean is doing well! Try to stay positive. I know it is so hard in a situation like this. Im glad you and they baby are ok. Cars are replaceable (even for an extra 3000, which sucks!) but lifes are not and Im so glad to hear you are ok.

What the heck kind of law is that!? That is just nuts and I am so sorry :-( so happy you and baby are okay .

That law is ridiculous!!! I'm so happy that your baby is ok though. That's the most important thing.

Can't you sue the other driver?? I was in a similar accident over a year ago, where I got rear ended into the car in front of me although I wasn't stopped, we were on a highway.

You should call a lawyer if you can. No fault laws aren't as clear cut as they sound (NJ is also a No-fault state but we successfully sued after an accident a few years back). First off, I believe car damages can be claimed by fault and even though your insurance only has to pay blue book value, they can then go ahead and sue the driver's insurance if there is a police report claiming it was his fault for the full amount (or at least close to it). The no fault applies to personal injury - suing for medical bills and/or inconvenience but that should be covered by PIP insurance which is part of your car insurance. Also, if you are really seriously injured, as my husband was, you can still sue even in a no fault state. Call a lawyer and ask him/her to look into what the specific MI laws are and see if he can at least get that $3K for you.

I actually googled the law because it sounded so ridiculous! And it does state that you can get a lawyer and sue. They also said that insurance companies try to deny all claims and don't come out and tell you that you are able to sue. You need a lawyer!

Oh geez how scary! I'm glad you and the baby are ok though. I also agree with the other ladies get a lawyer. I lived in a no fault state and you can get something.

Thanks I am seeing a lawyer Monday morning. She did tell me that its really hard to sue the other driver in Michigan but she may be able to do something. I am now spotting but I am thinking I am just stressed and in so much pain. Going to call my OB in the morning.
