I heard about it for the first time today.

Case of brain-dead pregnant Texas woman takes complicating turn - CSMonitor.com

In a short, a pregnant woman was declared brain dead in November. Despite her family's wishes to remove life support, the hospital won't, citing a Texas law. The hospital seems to be trying to litigate the case to get the fetus to between 24-26 weeks. The fetus is showing brain abnormalities and deformed limbs, possibly because of oxygen deprivation when the mother died.

It's a tragic story yet I think whatever is decided will set a precedent, at least in Texas.

That is very very sad. I wonder what is wrong with the baby.

Its absolutely horrific (I'm in Texas). Just heartbreaking all the way around. The attorney indicated today that the lower extremities were too deformed to allow them to determine gender, fluid on the brain and heart defects have all been detected at this point.

That sounds like a baby that is going to have zero quality of life.

IMO it's really a shame that they are even attempting to get this baby to viability. It's so backwards.

There's always a chance, but I don't think this baby has much of one to survive once being born. There are so many problems, and like they have pointed out in every article I've seen was deprived of oxygen for an unknown period of time during the most critical developmental part of pregnancy. I feel for the family. They were sure things wouldn't turn out well, and just wanted to respect the woman's wishes. I guess when I finally write up my living will and power of attorney I will have to put stipulations in there in regards to pregnancy and at what point I would want to be kept on life support or not.

You know what's crazy though? The woman DID have a DNR, but the hospital is stating that the Texas law trumps that because she is pregnant.

I had a dream about giving birth to a baby girl last night who was deprived of oxygen... it was messed up. Obviously this story made me really sad

I feel so awful for her husband. He's just lost his wife, is now a single father to a toddler, and now he can't begin grieving and healing because this hospital is misinterpreting the law and overriding the clear wishes of both the woman and the husband. Just horrible.

Actually she did not have a written DNR - had just verbally expressed her wishes to her husband and family. I have not seen a legal opinion as to whether if she had a written DNR that explicitly addressed pregnancy it would have over-ridden the law in question or not. Either way, all legal experts agree the law is being mis-interpreted in this instance.

Good. Judge ruled to remove her from life support. Such a travesty that the family was put through this for nearly two months.
