I am in need of your advice here, here is the backdrop:

I have 50/50 custody of my two kids (S5, S3). My older son is transitioning from a private school and about to start in the public school system. I work from home with a very flexible schedule whereas my ex works the usual 8-5:30 routine. The parenting plan states that any afterschool care costs would be shared 50/50 but does not have any language around the conditions for use of such a program. Since the divorce finalized last year I have never even once had the need to use the afterschool care program offered by the private school and was always there on time once the actual school ended.

Now here is the current situation, I want to provide afterschool care for my son (S5) even on his days whereas he is against this arrangement stating that kids are better off in the afterschool care program than with their biological parent. I have tried to make offers and be flexible to address his concerns but to no avail, there has been no change in his position. Now we are heading into arbitration.

My question is what is your advice on how to proceed and what information can I provide to the arbitrator to support my case?
