I'm watching an episode of Law & Order, and this came up:

Do you agree with charging a teenager who texts naked pictures of themselves with distribution of child pornography?

Yes and no. Technically, I think it is... but I would hesitate to charge a teen with something as serious as child pornography. Lesser charges, yes - but something that has very grave consequences that will follow them the rest of their lives I have a problem with.

Technically it is child porn if the person is underage.

I've heard of this before actually and it always confused me. I was never sure if there was some kind of age limit on when you can be charged with child porn. I mean yes technically if you are under 18 if your pictures are spread around and someone over 18 looks at them it's child porn but what about people of the same age bracket? Like an example, should a 15 year old boy who had naked pictures of his 15 year old girlfriend (she willingly gave him) be charged the same as a 30 year old man with pictures of a 15 year old girl?

Laws confuse m,e so much sometimes. I don't think the girl should get charged with distributing child pornography because they are pictures of her. If she was charged with something it should be at least something minor. Nothing harsh like having her be registered as a sex offender for her whole life and being stereotyped.

This was debated a few weeks ago...I saw a news story on it and posted the question. I think the general consensus was that the teens shouldn't become registered sex offenders, but there should be a penalty.

I understand kids will be kids, but parents need to be more involved and prevent it from happening in the first place.

This is why my kids will not be getting camera phones until they are mature enough to handle it and they can pay for it themselves. that's how i got my first cell phone. I had a job and paid for it on my own, phone, the service and everything, and it was a basic just talk/text. No camera or anything.

On topic, charging a teen with child porn is a bit extreme, IMO. They shouldn't be doing it in the first place, but i feel its more of a parent matter to deal with than the courts, and the teen shouldnt be punished for the rest of her life by doing something stupid. Teenagers will be teenagers. (now this doesnt cover every situation, just this one)

Now if the teen was sending pics of herself to much older guys, something should be done with THEM, as they should know better, with the teen being a minor and all, and they themselves are adults.

It's child porn, but the child who has it is also a child. Penalty yes, registered sex offender, no. The child who sends naked pictures also should get some sort of penalty. Kids need to know that this is not ok and there is consequences on both parts.
