It seems that Perez Hilton posted an upskirt shot of Miley Cyrus, allegedly pantie-less, exiting a vehicle.

He has removed the photo and, some sources are saying, he could be facing charges.


Thoughts?

If he really did post it- he should be charged. He knows her age, and should be responsible for what he posts.

Good. I hate that guy. IMO, websites like his are contributing to bullying. He is vile and I wish they would take his website down.

I completely agree. I think he is a complete misogynist and a bully. Especially the way he enjoys targeting young girls (e.g. Miley Cyrus, Vanessa Hudgens).

I honestly hope that he is brought up on charges because, regardless of my personal feelings about Perez Hilton or Miley Cyrus, allegedly, exposing her bajingo, this is clearly illegal and he should face the music.

I have read comments on some of the news stories, regarding this, from people that consider the thought of charges stemming from this to be outrageous, since she is a celebrity and went into public commando.

That's an awfully gray area. I'm not sure which way to go with it.

1) Ultimately the person responsible for the distribution is the photographer that shot and sold the image.

2) She's less than six months away from her 18th birthday (I looked it up), so I'm reluctant to assign the term "child porn."

3) She's a public figure who exposed herself. Everyone knows what happens when you wear a skirt with no panties and get out of a vehicle. It seems to be what actresses/singers do when they need a publicity boost.

4) A continuation of point No. 3, didn't she JUST give an interview about double standards in the industry, and how guys can be raunchy but girls can't...? Isn't the timing of this incident a HUGE coincidence?

In summation -- if Hilton is going to be charged, then probably everyone involved needs to be, as well, including the pap who sold the photo and Cyrus herself.

It's a gray area. I mean, we have no expectation of privacy in public, right? I mean, if I walk out on Hollywood Boulevard butt nekkid, and someone took a picture of me, I can't really claim I've been victimized, can I?

However, as much as I think "child porn" is a bit of an overreaction, I don't like the lack of accountability and responsibility the media had gotten lately. I was totally disgusted by the picture of Gary Coleman that was posted on the cover of the National Enquirer. I know it comes with a free press, and that a free press is the cornerstone of liberty, but wouldn't it be nice if people just grew a decency bone somewhere? For the love of Pete, I'm taking my kids to the grocery store, and this photo is splashed all over the place. How am I supposed to explain that to my boys, not get them upset, and at the same time not desensitize them to human suffering in this culture?

Just to add another level of idiocy to the whole thing, the photo could well be a fake. In fact, most likely is. Kinda takes the "she went out like that/knew what she was doing" wind out of our sails.

I agree she is not a "child" but she is a minor, hence it is termed "child pornography". It doesn't matter if she is 6 years, 6 months or 6 hours from turning 18. The law is the law is the law is the law. If he posted a picture of a minor's vagina, he should be prosecuted.

I don't understand what her statement about the double standard has to do with this picture being distributed. The law is very clear about this issue.

I'm shocked he posted the photo, to be honest. I think he is a perfect example of a media figure that needs to grow a decency bone and just stay the hell away from underage girls. This isn't the first time he's incurred wrath by targeting an underage celebrity.

Someone really needs to get a handle on how vulgar celebrity reporting is becoming. If it takes prosecuting Perez Hilton for legitimately violating a legitimate and perfectly sane law, I guess I do not have a problem with that.

I need to read the news more, because I don't what photo of Gary Coleman Torrie is talking about.

Anyways, I agree with Jess that if Perez were to be prosecuted, then everyone should be. If it's illegal for someone to text a naked photo of themselves to someone, then should it not be illegal to publicly expose yourself if you're a minor? (this is assuming she did and it's not a fake photo, which is most likely is anyways)

I do agree with Jess that if one is going to make an example of Perez Hilton, one should make an effort to track down the person who photoshopped the photo and originally uploaded it.

Ugh, I keep going back and forth on this though. I know the law is clear, but how much is the law really actually starting to border on a thought crime here?

I agree that the photographer that distributed the photo and anyone else who had any monetary gain from this photos distribution, should be prosecuted. Miley is the minor and, in my opinion, the victim here. Why should she be prosecuted. Aside from the obvious fact that, as a minor, she is not legally culpable, all she did was get out of a car.

If you were changing your child's diaper and someone snapped a photo and distributed it, would it be reasonable to say that you (an adult) should be charged for exposing your child's genitals in a public restroom?

I don't know about everyone else but I can assure you, if I had papparazzi following me on a constant basis, they would have had more than one opportunity to get an upskirt shot of me exiting a car. It was never on purpose but it has happened once or twice. As an adult, if the pic was circulated, I would have no recourse BUT, if my daughter were ever photographed in the same predicament, rest assured, there would be hell to pay if I found out.

The Gary Coleman photo is on the cover of the Globe, not the Enquirer. I apologize.
