It's sad that one is dead but I agree 100% with this judge. If the boy with the knife was significantly smaller than the aggressor, or if he feared the fight would be more than 1 guy against himself, I don't blame him 1 bit for having it. You can only expect a person to run in fear for so long. He should not have had to spend so much time running away.
I can't say the bully deserved to die, but he really has only himself to blame.

I would like to say I agree, however, he stabbed the kid TWELVE times. Once or twice would be considered self defense, in my opinion.

Oh, well, let's remind future potential victims that they need to keep count of how many times they strike out while they are being physically attacked. You know, they need to be thinking clearly through that adrenaline and all. I'm sure everyone is perfectly rational after a punch in the head.

Agree with both of these. There are anti-bullying laws and then people who are bullied and react to the aggressor are punished; makes no sense. He got hit first and then he had the right to defend himself. And I'm sure that the adrenaline was controlling that knife. I'm glad he got off without being punished. Maybe the bullies in the world will take notice.

While it is a heartbreaking story, I agree with the judge. The bullied kid got off the bus BEFORE the bully was planning on jumping him, the bully followed him and witnesses saw him punch his victim in the back of the head. It also states in the article the bully victim would skip school, or find other ways home to avoid contact with the bully.

Of course family and friends are going to defend the bully. I just don't see how they can still say this with all the facts presented and multiple witnesses to this kid bullying and going out of his way to torment this other kid. It was his actions that drove Saavedra (the bully victim) to feel the need to carry something to defend himself, and for him to actually USE that item.

I don't think anyone who is physically attacked is going to lay there and let themselves get beat up. I wouldn't. I would try my hardest to get away, and if it came down to their life or mine? Heck yea I would fight for my life.

It's sad that people have to die either from suicide because of bullying or from the victims defending themselves before it REALLY becomes an issue.

None of this should EVER have happened.

I think it just shows a lot of denial on the part family of the "victim". His mother refers to it as murder although her son is known to be the agressor in the situation. She makes no acknowledgement to the witnesses who saw an ongoing escalating situation where her son was agressing on a smaller, younger student. He may very well have been bullied before, when HE was the smaller & younger one. That does not make him incapable of being the bully. It may in fact have played into WHY he ended up becoming a bully. MANY bullies have been or are being bullied elsewhere. That is a reason abused children sometimes will abuse pets - because they burry all those feelings & then take them out on someone or something "safe" to take it out on.

Of course he shouldn't go to prison. Who would that serve? He acted in self defense. It is possible that he overreacted, but I think being a teen (especially 14 yrs old) it is difficult, if not impossible, to always assess the actual threat level of every situation accurately. he didnt' know if that one boyu woudl throw a few punches & walk away or smach his head in on teh sidewalk. He didnt' knwo if the other two boys woudl also join in. He had no way of assessing HOW bad it was going to be. I think he reacted like a frightened 14 yr old would in that situation & I find no fault either with what he did. He had every reason to think it was going to be really awful for himself & it woudl continue to be awful if he didnt' stand up now.

I agree with everybody else. This is my local area and I am glad that this boy is not being criminally charged. It is sad that someone died, but I would have done the same thing in this younger boy's shoes.

I agree with the decision. It's sad that it had to come to this. 1 boy dead & 1 who will have to live with killing someone.

I had a friend who was arrested & charged after he was gay bashed & decided he had enough & fought back. When the cops showed up, he was on top & was seen as the aggressor. I think he just snapped & he wasn't a small guy.
