Oregon mother, daughter reportedly sued for writing bad reviews of church online | Fox News

Can they do that?? How can this church be suing people when there's the freedom of speech? Do we really have to spend all our time kissing people's donkeys at the threat of a lawsuit if we say something that hurts their little feelers?

Stupid. nuff said.

But really not surprised. We've seen celebs sue for libel before and win (please don't make me go find an article I beg of you)... but I doubt this guy will win.

edit: I'm pretty sure the celebs often get settlements rather than actually win. So the person admits no wrong, but settles.

I don't think I really have enough information, but from the article, I'm inclined to think the lawsuit is a bit frivolous.

Libel is a real suit, though. I don't see it applying in this case. I do think it often applies in celebrity cases though. Here is the legal dictionary definition of libel:

1) n. to publish in print (including pictures), writing or broadcast through radio, television or film, an untruth about another which will do harm to that person or his/her reputation, by tending to bring the target into ridicule, hatred, scorn or contempt of others.

The bold is my own emphasis. The key points in libel are that the contested verbage is untrue and that it causes harm. From reading the article, it sounds like the mother and daughter's allegations in the blog posting are true (at least based on their own experiences), so the libel case would not hold up in court (of course, it all depends on the lawyers and judge/jury).

With the actor/actress example, many times it truly IS libel. There are many less reputable magazines and tabloids that quickly post untrue stories that harm the actor/actress's reputation. Of course, there are probably many cases where the story was true, but I would bet more often than not, when the paper loses/settles the article at least had shades of untruth to it.

I don't know as there's only one side of the story presented. If the girl is lying, I don't see it as frivolous. If she's telling the truth, then yes, I think its silly.

Here's a good case where someone is suing for (what I assume is) libel. A legit case. I don't want to start a new debate over the same sort of thing.

I feel so bad for this guy... something similar happened to a friend of mine in regards to his step kids.... but he never found out who made the accusations since it was an anonymous call.

I do and dont agree. I dont think the church should be allowed to sue them on those basis. However i CAN understant and see why they would, it could cause them to loose people.
On a side note in a similar situation however its for myself. If my ex has slandared and defamation/libeled me all over public pages such as facebook or myspace where people from the entire town we are both from as well as other cities can see it, lol, could i sue for it if i prove he has done it and its all false?
