My mom just got a court order today saying she owes Medicaid/Medicare of Idaho $16,000 for my grandma's estate....she had nothing! When she died all that was in her bank was $20 which my mom used to help pay for the funeral home to take out her difibulator, and she got like $300 from my grandmas deposit at her home, that also went to help pay for the cremation and other bills. All my grandma had was a couch, bed, tv, tons of books, food, kitchen things, clothes, shoes, bathroom things and a couple tables. This is a crock. My mom even had to get the city's help to cremate my grandma (over $1,400 just for that not including things like the urn, and difibulator removal and other small things).

Oh man!? WHY are they saying she owes that to them? At my work we deal strictly with Medicare...What is the reason they gave? Was Medicare/Medicaid paying for any kind of nursing home or ongoing medical supplies for her?

Cycle #10-11 - Met with first RE, diagnosed with heterzygeous MTHFR mutation & slightly low SA on all counts. -BFN, Cycle #12 - First IUI+Trigger - BFN, Cycle #13 - BFN
Cycle #14-15 - Met with new RE, diagnosed with a blocked right tube that previous RE completely overlooked or didnt care to mention. Soy (120mg) - BFN
Cycle #16 - Clomid (100mg) - BFN, Cycle #17 - Clomid (100mg)+Trigger+IUI - BFN
Cycle #18 - Acupuncture+Clomid (100mg) - BFN
Cycle #19-27 - 2 Soy (160mg) cycles, the rest all natural also 30lbs lost!! - BFN's
Cycle #28 - New RE is GREAT! Put on bcp 7/6/11, Lap surgery 8/1/11- Tubal cyst (5cm) found and removed, Uterine Septum removed, and Stage II-III endo removed. Cycle #29 - All Natural - BFN, Cycle #30 - All Natural - BFN, Cycle#31 - All Natural - BFN, DONE TTC FOR NOW

Nope she lived in a Senior home but it wasn't an assisted living one, she took care of her self. She had monthly pills and doctors every few months for her difibulator. My mom didn't say why other then they claim its for her Estate

I just talked to her and I guess they want $16,9xx for her medicaid/medicare and they say that my mom owes them all the money from her estate. She had $29 in her bank account when she died, my mom got around $300 from my grandmas house deposit back, and then just her belongings, I have about half of it still as my grandma told me to keep it when she died, and the rest was mostly donated, we did sell some at a garage sale but not much. My mom's really upset right now ontop of being called off work lots this month, and having a Leep done last week and having to miss work for that.

According to English law (although this is also very unknown here too) When a person dies there debt dies with them.

I didn't know debt could be passed down??? That's awful! Can she fight it?? I couldn't imagine... I'm sure it is already a difficult time, this is the last thing your family needs.

Shes trying to appeal. I had a couple tell me shes not responsible for this. Especially when she didn't have an estate and nothing of value(other then personal value)

Your mom doesn't owe them one red cent. Only a co-signer or co-owner would be responsible for debt after someone has passed, everything else would come out of the estate. Since there wasn't an estate, then that's just tough cookies for anyone your grandma owed money to. Debt collectors just like to take advantage of the raw emotions when someone passes and they figure they can scare your mom into paying. All she'll need to do is write up a letter essentially saying there was no estate and she is not responsible for the debt and they need to cease contact immediately. *hugs*

HUGS Justine....I hope it all gets sorted out. I would also say that if the estate has no money to pay debts then the debt must be forgiven....but I'm no estate attorney so I don't know. Good luck to your mom and your family.

I hope it gets all sorted out fast! My guess is that Medicare just decided to pursue outstanding bills and sent everyone a similar letter. They won't expect every letter to end up with cash for them. I think having a letter drafted by a lawyer and having it sent registered mail with some proof--like bank statements, etc should be good enough. But I'm not a lawyer. Good luck to your family!

From what we knew she didn't owe them anything. The way we understood it because she made so little from Social Secturity that she didn't pay for Medicare. she only made around $700/mo from S.S. She didn't own a house, or a car, just secondhand frunitrure and personal belongings that have no value other then to us. And her bank only had $29 when she died. My mom said she doesn't know if she has the bank statement but I'd think the bank could still pull it up from 4months ago?

Hmm...ive never heard of someone not having to pay for their Medicare coverage. You may want to look into that, and yes the bank can definitely pull up statements from months ago. I hope this all gets straightened out! Tell your mom not to worry, they're just trying to scare her into paying which surprisingly works alot of the time with our customers. They just get a bill and pay it because they assume it is correct.
