I'm curious about something.

My ex owes Danny over $5,000 in back child support, and adding more and more each day.

After he signs over parental rights, I know child support will stop. But what about that back support? Does that get 'forgiven' or does he still owe it?

Interesting.....
I would think that it would be all wiped off the record, not sure though. You can call your local child support collection agency and find that out. Let us know once you do!

He isnt responsible if you do not have a court order stating how much is to pay. And he is only responsible from when the court order was issued. Anything before that is null in void. Speaking from experience.

I was seperated from my EX for two years before I went for child support and when I finally got it I asked the judge for the back support and they said that there was none because no proof could be given because there were no receipts of monies received. So that the judge wouldn't charge him "twice".

I know when my son was born I put on the Birth cert father unknown...Then I decided to get help from the state and the state then brought us to court for cs and once they did that, I had to add him to the bc and I was able to get ALL the back support....He did pay it ALL up to....

Well, he is not on the birth certificate because he has never even been to see us (thank God for that ). However, we did go through the DNA tests and so he was proven by the state without the shadow of a doubt to be the biological father. The court order has been in place since Danny was like 9 or 10 months old ... there was no way I would have ever gotten ANY child support if I didn't get a court order.

Here where I live you would still get the back child support because it was for support THEN when he was responsible opposed to when Randy adopts him and he will not be responsible. However he is still repsonsible for what he was responsible for before the rigths were signed over.


So in simple terms lol yes I would say he would be.

A friend of mine went through a step parent adoption last year, and her ex had to pay every penny of the back child support up until the day his rights were terminated. I think he owed over $10,000, and the state went after him big time to get him to pay since he was no longer responsible for the monthly payments. I don't know any exact details, but if there are any specifics you want to know I can ask her.

I am in the same boat...My son has NEVER seen his dad and I am not complaining!!! When he is 18 and wants to know anything I will then talk about it....He has Never asked about him and I Never talk about him!!! He will be able to know what kind of dad he has when he gets older....Mike and I have been together since Brandon was 4 thats the dad figure he knows....

Ashley,

My sister's ex still had to pay until he was all done paying the back support even after her dh adopted her dd.

It might depend on the state.
