We got a call from the department of child support enforcement today, that they want to represent us in our CS case against BM. We don't actually want the CS, but we will put it all in an account for Owen for college or his first car. Anyway, the hearing is on Monday, and I doubt she'll show. We're apparently asking for current support and back support from March 1st. (Even though we've had him full time since September, the DCSE received our file on Feb 19th, when the Judge requested the hearing. I still think we should get from Sept since we filed all the paperwork asking for CS at the same time, and it's not our fault that they couldn't get us in until June, but we'll see.) I doubt we'll get blood from a turnip anyway, so I don't know what they do if she has no money. I know she gets government assistance, so hopefully she won't be able to receive anything for claiming she has Owen now.

In other news, we haven't actually heard from her since May 12th. Today was exactly a month. She told Owen on May 12th that she would "Call him tomorrow." I have since seen on her Google+ account that she is now "working" from "home" as a masseuse and getting "stronger and wiser as I age." So clearly she's still quite delusional. She also posted to some guy that he needed to come visit her because she lost her phone, and her computer. He replied he only had one shot left. She said, "F*** shots. I'm still having fun playing with your **** and I'm sobersobersober." So we think she's moved onto IV drugs.


Needless to say, she won't be going anywhere near Owen any time soon. He's doing great, he told us he doesn't love her anymore, which we tried to diffuse into a "Love her because she gave you life, but not like her for her choices."


Other than that, just trying to get pregnant, (I went in for a bunch of fertility testing and I seem fine, but DH has to go in for testing next week,) and enjoying summer!

Oh it's been wonderful! We have a child support hearing tomorrow, and assuming they calculate her at minimum wage for 40 hours a week, she'd have to pay us $258.14 a month. Plus we're positive that she gets government benefits like food stamps and such, and we're wondering if they will count that as income, or if they will just take away some or most of it when they find out that she doesn't actually have the child that she's receiving government benefits for.

She's gonna haaaaaaate us!

In GA, food stamps and other welfare program count as income in the CS calculator.

Good luck tomorrow! I'm mentally bracing for the tantrum that is sure to be headed your way afterwards.

I wonder if she'll show up. I hope it all works out in your favor. Good luck!

In FL, for my case they went all the way back to when exH should have been paying based on our mediated agreement. We didn't see the child support enforcement officer until 5 months later, after the judge ordered us there because my exH kept arguing with what he thought he should pay. When exH didn't have a job, the enforcement officer imputed wages as if he did have a job.


ExH had a chance to defend himself but everything my attorney said was true so he didn't really have a leg to stand on as to why he wasn't paying. The lady showed him no mercy.


Here for nonpayment of child support they suspend the payor's driver's license. That one is easy to get around. They just look to see if the person is paying something consistently and then can get back their license.


There is a federal limit of what is allowed in arrears, then the person's passport can be suspended until the amount is under some specific number. (I looked it up online after my attorney told me about it.) I turned in my ex for this as he liked to travel out of the country. This one is a pain to get sorted out!

I dunno though. She hasn't spoken to us or Owen in over a month. I said to Eric the other day I honestly wonder how long it will take her before she contacts us.

Like the old emergency order said her time was cancelled. The new one says any visitation is up to Eric. In her twisted mind, I expected her to assume that meant she was supposed to see Owen and just work it out with Eric. But nope. Nothing.

We declined CS when we originally filed our emergency order in September. Didn't want it to appear that our fight for sole custody was fueled by money. We asked for CS at the hearing on 2/5. So the lady we met with the other day said that she will likely have arrears dating back to March 1st, plus current support.


I just hope that her having to pay support won't encourage her to try to see Owen. We both think that she will work harder to finish school to become a nurse, rather than go to rehab to try to get her son back.


It's all just become quite comical, sadly.

So he's back.

She never showed. (Shocking right?)


They calculated her at 40 hrs a week making minimum wage. They also calculated all the way back since we got full custody in October.


She owes us $2304 in back support
She owes us $273 a month in current support


She gets to claim him on taxes every 3rd year, but only if she is current, with no arrears. Any taxes she claims get intercepted and come to us until her arrears are gone.

Wonderful!

And no way will she ever get a job as a nurse. They drug test. Heck most of corporate America makes you take drug test before they hire. I have to take drug tests to get jobs in my field & I sit at a desk, don't touch people and am no where near medications.

It seems as if she is choosing finishing school to become an LPN rather than going to rehab. I'm curious as to why she would think that skipping rehab that just 3 months ago she said she needed 90 days of, is a good idea.


I'm sure they will drug test, but she could always pass a drug test she knows is coming.


If they do a background check, which most hospitals around here do, she's done.

In Arizona, when the parent doesn't pay for 12 months, AND the balance is over 5,000- they get their license suspended and an arrest warrant for child support evasion. She's at 2300, and in 12 months, if she doesn't pay, she'll be over 5,000.

If she doesn't stop the drugs to see her only son, I doubt she'll be able to to stop long enough to take a drug test. Even if by some miracle she does, she'll get busted in a minute - surrounded by nurses & doctors - they'll know in a heart beat.

DH spoke to grandpa today. He says that she is still waiting to get into a place. I don't think I believe that. But grandpa seemed very removed from the situation, as if he really doesn't know or care.


Owen will be going out to dinner with them tonight. We struggled to allow them to take him, but they know the rules, and Owen has his phone. BM has no car, so I doubt she could follow them. And I am home all evening, and Owen can call if something happens. I honestly don't think grandpa would risk it, knowing that THEY would be in violation of the court order if they allowed her near Owen. We wouldn't let him go if we didn't feel he would be in safe hands.

Well he just got home.

No talk of BM. They didn't talk about her, nor did they try to get him to see her. He did, however, forget his phone at their house. Luckily this is a phone we just set up for him, (long story short Eric got a new phone and we downgraded Owen to Eric's old one,) so there isn't much on it, in case grandma or bm were to snoop.


I'm a little irritated that they went to their house, seeing as though BM could have easily just shown up looking for money or whatever.. but I'm trying to focus on the positive side that Owen got to spend time with his grandparents that he missed.

I'm sure her father had to remove himself from the situation. It must be hard to watch your child self destruct. There's nothing he can do for her now. He has to protect himself & his relationship with Owen.

Good point. My mom said that maybe they didn't think it would be a big deal to bring Owen there because maybe they know something about her that we don't and they know for a fact that she wouldn't show up.

Who knows. All I am focusing on is the fact that he had a great time with them and BM's name wasn't even brought up.

As someone who has assistance right now, I am pretty sure her claiming the child she doesn't have custody of is actually fraud and I think that's a felony, isn't it?

I believe so. Again, we are only assuming she is claiming she has him for food stamps.


We got a letter from his school in April that said, "Due to your recent approval for government assistance, (Food stamps,) you qualify for free lunch."


So we're not sure.
