I have my first Appointment with our Attorney tomorrow morning, I'm a little nervouse although I don't know why. We will officially be starting all the legal parts of this adoption. So far it's just been a verbal agreement between my brother an S.I.L. with my DH and myself. I can't hardly believe that in just a little over two months the baby will be born, and be here with us.

<span style="font-family:Georgia">Yes it is very so Bensmom, I'm anxious to get the legal paper work started and than so worried about what all I'm going to have to go thru. I guess I'm pretty lucky that we are waiving the homestudy, I won't feel so bad about how messy the house is at least.

Marla, I most definitely be posting on how things went and what all I find out.

I leave here in about an hour and 15 minutes so I'm trying to stay busy till time to go. I put a coat of water proof down on the addition floor the house smells bad, and I think it gave me a slight head ache. I had to block the room off from the cat and dog so they don't get into it.</span>

O.K. this is what I found out.

First off the birth parents need to contact DHS and find out; if they put this baby up for adoption what type of monetary or legal ramifications would the adoptive parents face? Since they are paying for this using state help, last time my attorney did an adoption like this there were no ramifications.

Once they know the answer than they need to contact Mercy Hospital about letting them know about them putting the baby up for adoption. And that the birth parents would like to know what type of paperwork if any the hospital will need or have filled out prior to birth.

If the hospital isn't in the loop soon they will most likely not allow Charles and I in the delivery room and they will not let the baby leave with Charles and I.

72 hours after birth the birth parents will have to sign a consent to terminate their parental rights. Once that is signed it will be attached to Charles and I's petition to adopt the baby.

My Attorney will be out of his office the second week of November so if we are going to need legal papers signed or filed for Mercy Hospital we'll need to know so I can have him draw them up and have them in hand at time of delivery.

At first he thought we would have to have the baby in our home for 180 days before finalizing the adoption but according to Iowa state codes and the type of adoption this is we are able to waive it, and could have everything finalized by the end of the year.

The reason that they have to contact DHS and the hospital is because my brother didn't want us to tell anyone that they were putting the baby up for adoption and that I and my DH were adopting it, in case the state decided to stop paying for all the appointments that they are currently doing because my Brother and SIL financially can't afford insurance, so they have a state subsidy that will pay for the doctor bills and delivery bill.

But you're right it does sound confusing ... I've personally known this Attorney for years well since 1990 to be exact and as an acquaintance for even longer so I trust him and I know his work ethic. I'm just glad he's on my side .. LOL

I am currently waiting to hear from my brother and SIL but since they are going to be here for short time on Sunday they may not send me word as to whether they have made any phone calls or not. I'm so happy to have the legal end of this finally rolling along.

And I just had that blinkie waiting to use it when the time was right and well I was pretty sure that the time was right so I had to use it. LOL
