Seems to think it is ok to smoke right outside my living room window and blow smoke INTO my house which then lingers down the hall into both bedrooms, so needless to say my house STINKS! Management cannot do anything about it since she has the right to smoke...we even called the cops and they cannot do anything...im so pee o'd!

I would be super upset too! Have you talked to her about it?

Ugh. My mom lived (well, til tomorrow) in a townhouse and always said she had a 3am smoke with the neighbor when the windows were open. Sucks so much. But it is, in fact, her right to smoke on her property and not against the law.

Any chance you could sweetly talk to her (a pan of brownies might not hurt) about smoking either somewhere else or turning a different direction? Maybe worth a shot.

Our old neighbor used to do the same thing!!! One night we were playing Wii and we had the window open and the smoke literally started filling our living room. My hubby just went out and asked him to smoke by his window and he apologized. The first and last time he was EVER polite to us. butthole.

When I lived in a duplex our downstairs neighbor was a chainsmoker, After she moved in me and the kids were constantly getting upper respiratory infections until we finally got out of there. The landlord asked her to smoke outside, but I'm pretty sure she wasn't bothering most of the time.

So I have talked to her and I said to her VERY kindly "Hey, would you mind not smoking near my window please? I am asthmatic (I really am) and I have a 16 month old and our house is filling with smoke." She said to me "Close your windows!" So I explained to her that by the time we smell it, its too late and it is already in our house so closing the windows would trap the smoke in, she continued to tell me she would not stop, so I got MAD! I said to her "Thank YOU FOR ALTERING MY LIFE AND THANK YOU FOR GIVING MY SON CANCER!" I was so mad. So like 5 hours later she knocks on the door and says she came up with a compromise. She would text me every time she went out so I could close my windows before she lit one. I agreed, and it has been working great. Fingers crossed!
